CONDITIONS OF CONCLUSION OF THE CONTRACT

  1. Internet shop nowymodel.org conducts retail sales via the Internet. Orders are accepted only via the website.nowymodel.org
  2. To place an order, you must have an account in our Store. You can create an account on our website.nowymodel.org
  3. The basic condition for order fulfillment is the correct completion of the account address form and acceptance of the provisions of these Regulations.
  4. The information on the nowymodel.org store's website does not constitute an offer within the meaning of the Civil Code. By placing an order using the mechanisms available on the nowymodel.org website, the customer is making an offer to purchase a specific product under the terms specified in the product description. The purchase and sale agreement is concluded upon confirmation of the order by the store. nowymodel.org.

PRODUCT AND PRICE

  1. All products offered in the store nowymodel.org are free from physical and legal defects and have been legally introduced to the Polish market.
  2. Unless otherwise specified for a product or product section, all products offered by the Store are brand new.
  3. In the store nowymodel.org Product prices are quoted net (excluding VAT) and gross (including VAT). If the price does not include the terms "net" or "Plus ... VAT," it means the price is gross.
  4. The gross price displayed next to the product at the time the Buyer places the order is binding on the parties to the transaction.
  5. After placing an order, the Customer will be sent an email confirming receipt of the order by the Store. If the ordered product is available, the Customer will receive a confirmation of acceptance of the order. This confirmation will include the Customer's details, a list of ordered products, the delivery date, pickup information, product prices and delivery costs, and information on available payment methods.

DELIVERY TERMS AND PAYMENT METHODS

  1. Shipping costs are covered by the customer. Ordered goods are delivered via specialized courier companies. The buyer is responsible for the delivery costs specified in the "Transportation Costs" section. Shipping costs depend on the current prices of the transport companies, the dimensions, quantity, and weight of the ordered goods.
  2. The following payment methods are possible:
    1. By bank transfer – after the ordered goods are reserved in our warehouse, we send the Buyer an email with our bank account number. Once the transfer is received in our account, the goods are packed and shipped.
    2. Payment via electronic channel – via the payment system www.payu.pl.
    3. Payment upon personal collection at the DigiTouch office, ul. Różana 6, 62-002 Suchy Las near Poznań
  3. In the case of certain types of products, nowymodel.org reserves the right to limit the use of certain payment methods and to limit the choice of delivery company.
  4. Unless otherwise stated for the product, order processing takes up to 21 business days. If the processing time is longer than stated on our website, we will contact the buyer to inform them of the delay and confirm their willingness to continue processing the order.
  5. Delivery date = order processing time + delivery time.
  6. For payments by bank transfer, the above deadline is extended by the transfer processing time. Parcels are usually delivered by courier the next business day after shipment from our warehouse.
  7. All transaction terms will be negotiated via email to the following address: info@nowymodel.org. The buyer will be notified of order acceptance via email. Order acceptance will be confirmed within two business days of placing the order.
  8. All Store promotions and sales are valid while stocks last.

WARRANTY AND COMPLAINTS

  1. Products are covered by a quality warranty from the manufacturer, importer, or seller, valid in Poland. Unless otherwise specified, the warranty period for products sold at nowymodel.org is 2 years. Detailed warranty terms are specified in the warranty form issued by the guarantor or in the warranty statement submitted by the guarantor.
  2. The Store is liable under the warranty in accordance with the principles set forth in the Civil Code if a physical defect is discovered within two years of the date the item was delivered to the Buyer. The Buyer must request removal of the defect or replacement of the sold item with a defect-free item within one year of the discovery of the defect. For non-consumer Buyers, the warranty is excluded. The Store is liable for two years from the date of purchase in the event of nonconformity of the goods with the contract, in accordance with Article 10 of the Act on Special Conditions of Consumer Sales of July 27, 2002. The Customer loses the rights specified in the aforementioned Act if they fail to notify the Store of this fact within two months of the discovery of the nonconformity of the goods with the contract. In the case of a sale that does not constitute a consumer sale, the provisions of Articles 556-576 of the Civil Code are excluded.
  3. The purchaser of goods as a consumer (a natural person entering into a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity) has the right to withdraw from the sales contract within 14 calendar days from:
    1. the day following the day on which the consumer received the item – in the case of a contract for the sale of a single item;
    2. the day following the day on which the consumer received the last item, batch or part – in the case of a contract for the sale of several goods delivered separately, in batches or in parts;
    3. the day after the consumer receives the first of the ordered items – in the case of a contract involving regular delivery of goods over a specified period. The consumer covers all direct costs of returning the items (e.g., packaging, security, and shipping costs).
  4. Withdrawal from the contract takes place by submitting a declaration. If you wish to submit the declaration in writing (withdrawal form below), the written declaration should be sent to the following address: 62-002 Suchy Las, ul. Różana 6, Poland or submitted to the registered office of DigiTouch sp. z o. o. To meet the deadline, it is sufficient to send the declaration before its expiry.
  5. The consumer is obligated to return the goods immediately, but no later than 14 calendar days from the date on which they submitted their declaration of withdrawal from the contract. To meet this deadline, it is sufficient to send the goods back before their expiry. The consumer is obligated to carefully pack and secure the goods being returned to the Seller. Failure to return the goods within this deadline may result in the consumer being liable for damages. The buyer is liable for damages for any diminished value of the goods resulting from actions that go beyond what is necessary to familiarize themselves with the goods.
  6. The store is obligated to immediately, and no later than 14 days from the date of receipt of the declaration of withdrawal from the contract, refund all payments made by the consumer, including delivery costs. The store may withhold reimbursement of the payment received until the returned goods are received or the consumer provides proof of shipment. The seller will refund the costs of the cheapest standard shipping method available in its offer, regardless of the mode of transport selected at the time the consumer placed the order. The consumer will cover the costs directly associated with returning the goods after submitting the declaration of withdrawal from the contract (including the costs of returning the goods to the store).
  7. In the event of a warranty claim, the Customer must submit a written complaint to DigiTouch Sp. z o. o. within the timeframe specified in Section 19 above, with a detailed description of the reasons for the complaint. The complaint will be reviewed within 14 days of receipt of the written notification. Failure to respond within this timeframe constitutes acceptance of the complaint.
  8. In the event of any concerns regarding the quality of the delivered goods, a written complaint must be submitted to DigiTouch Sp. z o. o. within the time period specified in Section 18 above, with a detailed description of the reasons for the complaint. The complaint will be reviewed within 14 days of receipt of the written notification.
  9. When specifying the manner of fulfilling obligations, the Customer has the right to request that the goods be repaired, replaced with defect-free goods, a price reduction, or withdrawal from the contract – if the defect is significant. When specifying the manner of fulfilling obligations, the Buyer has the right to demand that the goods be brought into conformity with the contract through free repair or replacement, unless repair or replacement is impossible or requires excessive costs. If the store is unable to meet these demands, the Buyer has the right to demand an appropriate price reduction or withdraw from the contract.

FINAL PROVISIONS

  1. The provisions of the Regulations apply to orders placed from 25 December 2015.
  2. In matters not regulated by these Terms and Conditions, the provisions of the Civil Code and other laws shall apply. The Parties hereto undertake to strive to resolve any disputes arising from the performance of this Agreement amicably. In the absence of an amicable resolution, any disputes between the Parties shall be subject to resolution by a court with subject matter and local jurisdiction.
