Privacy Policy

Due to the entry into force on 25 May 2018 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (GDPR), we would like to inform you about the principles of processing your personal data by us:

  1. DATA CONTROLLER
    The controller of your personal data is Digitouch spółka z ograniczoną odpowiedzialnością (owner of the nowymodel.org brand) with its registered office in Suchy Las, address: ul. Różana 6, 62-002, Suchy Las, entered into the register of entrepreneurs of the National Court Register, maintained by the District Court Poznań – Nowe Miasto and Wilda in Poznań, 8th Commercial Division of the National Court Register, from 08/04/2002 under the KRS number: 0000103375, Tax Identification Number (NIP): 777-26-35-162, Regon: 634293184.
  2. TYPE OF DATA PROCESSED
    The following data may be processed: name, surname, e-mail address, telephone number, address, IP address and additional information necessary to process the inquiries and notifications you send to us (e.g. via the contact form or registration in our online store) and to contact you, including for purposes related to the provision of services.
  3. BASIS FOR DATA PROCESSING
    The legal basis for the processing of your personal data is the necessity of such processing for the performance of the contract (if we provide you with services), as well as our legitimate interest, in particular to enable the pursuit of possible claims and to be able to ask for your consent necessary to present our commercial offer.
  4. PURPOSE OF DATA PROCESSING
    The personal data you provide will be processed for the following purposes:
    1. a) performance of the sales contract for products offered by Digitouch Sp. z o. o. (owner of the nowymodel.org brand) – pursuant to Article 6 paragraph 1 point b) of the GDPR – processing is necessary for the performance of the contract, until the contract is terminated;
    2. b) direct marketing – pursuant to Article 6 paragraph 1 point f) of the GDPR – the legitimate interest of Digitouch Sp. z o. o., until the contract is terminated or an objection to data processing is lodged;
    3. c) financial and accounting purposes – pursuant to Article 6(1)(c) of the GDPR – processing is necessary to comply with legal provisions, including tax provisions, including Article 74 of the Accounting Act, for the period required by the relevant provisions of tax law;
    4. d) defending against claims and pursuing claims – pursuant to Article 6 paragraph 1 point f) of the GDPR – the legitimate interest of Digitouch Sp. z o. o., until the expiry of the claims period in accordance with the Civil Code;
    5. e) conducting complaint processes – pursuant to Article 6 paragraph 1 point f) of the GDPR – the legitimate interest of Digitouch Sp. z o. o., for a period of 5 years from the termination of the contract;
  5. DATA RECIPIENTS
    In connection with the purposes referred to above, the recipients of your personal data may be entities acting as intermediaries in the performance of contractual obligations by the controller, e.g. IT service providers, accounting firms, law firms, and delivery and courier companies.
  6. DATA PROCESSING PERIOD
    Your personal data is processed on a voluntary basis and will be processed only for as long as necessary to achieve the aforementioned purposes or until you effectively object to its processing. The personal data processing period may be extended by the limitation period for claims if the processing of personal data is necessary to pursue or defend against potential claims.
  7. DATA SUBJECT RIGHTS
    Because we use your personal data, you have:
    • the right to withdraw consent to data processing,
    • the right to access your personal data,
    • the right to request the rectification of your personal data,
    • the right to request the deletion of your personal data,
    • the right to request the restriction of the processing of your personal data,
    • the right to object to the processing of your data due to your particular situation – in cases where we use your data based on our legitimate interest,
    • the right to transfer your personal data.
